PRIVACY ACT AUTHORISATIONS/AGREEMENTS
Acknowledgement of Disclosure of Credit Information to a Credit Reporting Agency
The Applicant acknowledges that Section 18E(8)(c) of the Privacy Act allows any credit provider which the abovenamed Introducer may approach in arranging the Applicants finance (hereinafter the Approached Credit Providers), to give a credit reporting agency certain personal information about the Applicants application for finance. The information which may be given to an agency is covered by Section 18E(1) of the Act and includes:
- such permitted particulars about the Applicants which allows the Applicants to be identified;
- the fact that the Applicants have applied for finance and the amount;
- the fact that the Approached Credit Providers are a current credit provider to the Applicants;
- payments which become overdue more than 60 days, and for which collection action has commenced;
- advice that payments are no longer overdue;
- cheques drawn by the Applicants which have been dishonoured more than once;
- in specified circumstances, that in the opinion of the Approached Credit Providers, the Applicants have committed a serious credit infringement;
- that finance provided to the Applicants by the Approached Credit Providers has been paid or otherwise discharged.
By virtue of this declaration the Applicant understands that the abovenamed Introducer has informed the Applicant of the disclosure policy to a credit reporting agency of information about the Applicant by Approached Credit Providers and so authorise such disclosures.
Agreement/Authority for Credit Provider to Perform Certain Permitted Actions Concerning a Finance Application or Transaction.
The Applicant agrees that, if it is considered relevant in assessing the application for personal credit, the Approached Credit Providers may obtain a report about the Applicants commercial activities or commercial credit worthiness from a business which provides information about the commercial credit worthiness of persons (Section 18L (4)).
The Applicant agrees that, if it is considered relevant in assessing the Applicants application for commercial credit, the Approached Credit Providers may obtain from a credit reporting agency a credit report containing personal credit information about the Applicant (Section 18K(1)(b)).
The Applicant agrees that the Approached Credit Providers may give to and seek from any credit providers named in the accompanying finance application and any credit providers that may be named in a personal or commercial credit report issued by a credit reporting agency or a commercial credit reporting agency respectively, information about the Applicants personal or commercial credit arrangements for the purposes of assessing the Applicants finance application or collecting in overdues; the Applicant understands that this information can include any information about the Applicants credit worthiness, credit standing, credit history or credit capacity that credit providers are allowed to give or receive from each other under the Privacy Act (Section 18N(1)((b)).
The Applicant agrees that the Approached Credit Providers may give to and seek from any credit providers named in the accompanying finance application and any credit providers that may be named in a personal or commercial credit report issued by a credit reporting agency or a commercial credit
reporting agency respectively, information about the Applicants personal or commercial credit arrangements for the purposes of assessing the Applicants finance application or collecting in overdues; the Applicant understands that this information can include any information about the Applicants credit worthiness, credit standing, credit history or credit capacity that credit providers are allowed to give or receive from each other under the Privacy Act (Section 18N(1)((b)).
Authorisation to Act on Behalf of Individuals
For the purposes of arranging the finance which is the subject of the Applicants application, the details of which appear below, the Applicant authorises the abovenamed Introducer to obtain a report about the Applicants consumer or commercial credit worthiness from a credit reporting agency or a commercial credit reporting business (Section 18H(3)) or from credit providers named in this application or referred to in such reports. (Section 18N(1)(ga)).
The Applicant also authorises the abovenamed Introducer to pass on the above-obtained reports to such credit providers as are appropriate, for their consideration of this application.
The Applicant also authorises the abovenamed Introducer to give to and receive from such parties as are necessary to the arranging of this finance, such personal information about the Applicant which is necessary to the arrangement.
Authorisation to Access Information on an Ongoing Basis
The Applicant authorises the abovenamed Introducer to obtain information from the financier during the duration of the contract for finance for the purposes of assisting with the Applicants ongoing management of the facility, until the Applicant notifies the financier in writing that such authority is withdrawn. This may include payout figures, copies of contracts or other details deemed appropriate.

“The Introducer” will ensure that personal information provided by you is updated annually to ensure that all records are current and accurate.
“The Introducer” will ensure that all-personal information provided by you is kept secure and cannot be accessed by unauthorised people.
“The Introducer” will not use or disclose or permit the use or disclosure of any personal information unless one or more of the following apply:
- you have provided your consent;
- it is in accordance with this Privacy Policy Statement;
- “The Introducer” believes that such use or disclosure is necessary if it suspects fraud or unlawful activity has been, is being, or may be engaged in;
- the use or disclosure is required or authorised by law;
- “The Introducer” believes that the use or disclosure is necessary to assist a law enforcement body or national security body in the performance of its functions, or the use or disclosure relates to the preparation for, conduct of, or orders arising and of legal proceedings of a court or tribunal.
